These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CreatorFormat ("we," "us," or "our") regarding your access to and use of the CreatorFormat website at creatorformat.com, including our free online tools and optional premium services (collectively, the "Service").

6.3 Beta Access

7. User Content and Intellectual Property
7.1 Your Content Ownership
You retain all ownership rights to your manuscripts and content ("User Content") that you upload to the Service. We do not claim any ownership rights to your User Content.
7.2 License Grant to Us
By uploading User Content, you grant CreatorFormat a limited, non-exclusive, worldwide license to:
- Store, process, and format your manuscripts
- Generate output files (PDF, EPUB) based on your specifications
- Perform technical operations necessary to provide the Service
- Create backup copies for data protection purposes
This license terminates when you delete your User Content or close your account, except for backup copies retained for legal or operational purposes.
7.3 Content Representations
You represent and warrant that:
- You own or have the necessary rights to upload your User Content
- Your User Content does not infringe on any third-party intellectual property rights
- Your User Content does not violate any applicable laws or regulations
- You have obtained all necessary permissions for any third-party materials in your User Content
7.4 Our Intellectual Property
The Service, including its design, code, algorithms, features, and branding, is owned by CreatorFormat and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or create derivative works of our Service
- Reverse engineer, decompile, or disassemble our software
- Remove or alter any proprietary notices
- Use our trademarks without permission
8. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Upload content that is illegal, harmful, threatening, abusive, defamatory, or obscene
- Upload content containing viruses, malware, or other malicious code
- Violate any intellectual property rights
- Impersonate any person or entity
- Harass, threaten, or harm others
- Attempt to gain unauthorized access to our systems

Upon termination, your right to use the Service will immediately cease. We may delete your User Content, though we will provide reasonable notice when possible.

Our Service integrates with third-party services:
- Paddle: Payment processing

- The availability, accuracy, or functionality of third-party services
- Any data practices of third-party services
- Any losses resulting from your use of third-party services
11. Disclaimers and Warranties
11.1 Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
11.2 No Guarantee of Results
We do not guarantee that:
- The Service will meet your specific requirements

- Formatting output will be accepted by all publishing platforms
- Any errors will be corrected
11.3 Quality Assurance
While we strive to provide high-quality formatting, you are responsible for reviewing and approving all output before publishing. We are not responsible for any errors, omissions, or formatting issues in your final published work.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATORFORMAT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information
- Any interruption or cessation of the Service
- Any bugs, viruses, or malware transmitted through the Service
- Any errors or omissions in any content
- Any loss of your User Content
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

14. Copyright and DMCA
14.1 Copyright Policy
We respect intellectual property rights and expect our users to do the same. We will respond to valid notices of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

If you believe that your copyrighted work has been infringed, please send a written notice to our designated Copyright Agent:

You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
17. Dispute Resolution and Arbitration
17.1 Informal Resolution
Before filing a claim, you agree to contact us through our website to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.
17.2 Binding Arbitration
If informal resolution fails, you agree that any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that:
- Either party may seek injunctive or other equitable relief in court
- You may bring a claim in small claims court if it qualifies
Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) rules. The arbitrator's decision will be final and binding.

YOU AND CREATORFORMAT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
17.4 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.
18. General Provisions
18.1 Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes:
- We will update the "Last Updated" date
- We will notify you via email or through the Service
- Changes take effect 30 days after notification
- Continued use of the Service constitutes acceptance of the changes
18.2 Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and CreatorFormat regarding the Service.
18.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
18.4 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
18.6 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, or infrastructure failures.
18.7 Survival
Sections that by their nature should survive termination will survive, including: ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution.
